The EU’s Directive on Unfair Trading Practices (UTP) in the agri-food supply chain and the Corporate Sustainability Due Diligence Directive (CSDDD) tackle the same underlying problem – power imbalances between buyers and suppliers in global supply chains – but through different mechanisms. This webinar aims to build a shared understanding among partners of how the two instruments interact.
The timing is significant: The public consultation on the CSDDD guidelines is open until 24 July and includes specific questions on purchasing practices and contracts. Understanding the UTP Directive’s black- and grey lists of harmful trading practices can strengthen CSDDD implementation, for example by pointing the guidance towards a clear, operational list of red-flag purchasing practices that companies can use during risk scoping and that enforcement authorities can refer to.
The webinar will cover, among other things:
- How a clear framework of unfair purchasing practices could support companies‘ risk identification under the CSDDD, particularly given the constraints on supplier information requests during initial scoping
- How the UTP Directive could serve as a transformative tool for the many companies falling outside the CSDDD’s scope, and concrete proposals for integrating remedy mechanisms and a new UTP addressing „cut and run“ dynamics within the revision
The first half of the webinar will be dedicated to short presentations from FTAO and ECCJ, followed by open discussion and Q&A.
